Cancellation of Removal

If you face deportation in Immigration Court, the process can be complicated and intimidating. Cancellation of Removal may be an option for you to stay in the United States as a lawful resident. Cancellation of Removal is available for immigrants without status and for green card holders.

If you are in deportation proceedings and have no lawful status in the United States, you may qualify for Cancellation of Removal if:

  • you have been physically present in the United States for 10 years;
  • you have not committed certain criminal acts;
  • you have been a person of good moral character for the 10 years;
  • your removal would result in exceptional and extremely unusual hardship to qualified family members.

If you are in deportation proceedings and are a Lawful Permanent Resident of the United States, you may qualify for Cancellation of Removal if:

  • you have lawfully admitted as a permanent resident for not less than 5 years;
  • you have resided in the United States continuously for 7 years after being lawfully admitted;
  • you have not been convicted of an aggravated felony.

If you qualify for Cancellation or Removal, you may be able to fight your deportation and stay in the United States with a green card. It is highly recommended that if you are facing deportation, you contact an experienced immigration attorney. Dorsett Immigration Law has succeeded in winning Cancellation of Removal for both Lawful Permanent Residents and non-green card holders.
